A November 2008 study by the Massachusetts Medical Society found that 83% of its doctors practice defensive medicine at a cost of at least $1.4 billion a year. Here's a chart:

Does anybody want to argue that malpractice is not a problem? Case closed.

Previous estimates are that the malpractice system adds 10% to the nation’s health bill. This survey suggests to me that the real cost is higher than that.
